Appeals to the University Misconduct and Fitness to Practise Committee

Students who are not satisfied with the outcome of their College Misconduct or Fitness to Practise Committee may appeal against the decision.

Appeals must be submitted within 15 University working days of the date of the College Misconduct or Fitness to Practise Committee outcome letter, on the following form:

Appeal to University Misconduct or University FTP Committee form (Word - 65 KB)

You may appeal on one or more of the following grounds:

  • the sanction is disproportionate to the offence
  • a procedural irregularity
  • relevant new evidence which was not available at the time of the initial hearing
  • the outcome is disproportionate to the fitness to practise impairment that needed addressing (for students     registered on Fitness to Practise programmes only).

It is important that you include as much information as possible, that you complete all relevant sections of the form and that you include any supporting evidence (where appropriate).

When considering appeals, the University Misconduct and Fitness to Practise Committee has all of the sanctions and outcomes available to it if it decides that the sanction imposed or outcome decided by the College Misconduct and Fitness to Practise Committee is not appropriate.

Whilst any misconduct and fitness to practise proceedings are ongoing (including an appeal to the University Misconduct and Fitness to Practise Committee), there may be an impact on your ability to access certain services (such as SCONUL), progress on your programme and/or graduate.

The procedure for the processing of such appeals is set out in the Code of Practice on Misconduct and Fitness to Practise Committee, which can be found on the relevant legislation webpage for your cohort.
